2. Description of the Service
Club de Spanish is a Spanish conversation club that organizes online debates among previously approved participants.
Access may be:
- Free access: up to two debates per month.
- Paid access (monthly membership): up to two debates per week and access to a credit compensation system in the event of cancellation by another participant.
Access to the Student Area is available to both free and paid users.
3. Access Requirements and Right of Admission
The service is exclusively intended for individuals over 18 years of age.
To participate:
The applicant must attend a prior video call with the service provider.
During this call, the following will be verified:
- The applicant’s real identity.
- Their level of Spanish.
- Their ability to maintain a fluent conversation.
Club de Spanish reserves the right of admission.
The organization may deny or cancel a membership if it determines that the user does not meet the minimum requirements or does not align with the spirit of the club.
4. Rules of Conduct
During debates, the following are strictly prohibited:
Insults, harassment, or discriminatory behavior.
Offensive comments based on gender, religion, sexual orientation, nationality, or origin.
Spam or external promotion.
Explicit sexual content.
Conduct that deliberately disrupts the debate.
Violation of these rules may result in permanent expulsion without refund, at the sole discretion of the organization.
Debates do not have a permanent moderator.
5. Recordings, Screenshots and Use of Image
5.1 Recordings by Participants
Any audio or video recording is strictly prohibited without prior written authorization from all participants and the organization.
Screenshots are also prohibited.
5.2 Recordings by the Organization
Club de Spanish may exceptionally record certain debates.
In such cases:
- Participants will be informed in advance by email.
- Recording will only take place if all participants give their express consent.
- Recordings may be used for internal analysis, service improvement, and promotion of the service, subject to additional specific consent when required.
6. Use of Educational Content
All content provided by Club de Spanish is for personal use only.
It may not be reproduced, distributed, or shared.
It may not be used to train artificial intelligence systems.
It may not be used to create derivative or competing services.
7. Debate Assignment and Participation Requests
Submitting the availability form does not guarantee assignment to a debate on a specific date.
Assignment depends on matching schedules among participants, actual availability, and the proper functioning of the system.
There is no guarantee of obtaining a place on a specific date.
8. Cancellations and Absences
8.1 Cancellation by the Participant
Debates may be cancelled through the Student Area up to two (2) hours before the scheduled start time.
After this deadline, formal cancellation will no longer be possible and absence will be considered a no-show.
If a participant cancels within the allowed time, the debate is cancelled for all participants, the debate page is closed, and participants receive email notification.
8.2 No-Show
A no-show occurs when a participant fails to attend a debate without cancelling at least two hours in advance.
In the event of a no-show, the session will be forfeited, no compensation will be granted, and the organization may limit future participation in case of repeated absences.
9. Conditions According to Type of User
9.1 Free User
Free access allows up to two debates per month.
If a debate is cancelled by another participant, no automatic compensation will be granted, no additional credit will be issued, and no refund applies.
9.2 Paid User (Monthly Membership)
Paid access allows up to two debates per week.
If a debate is cancelled due to cancellation or absence by another participant, the affected user will receive a compensatory credit.
The credit allows participation in one additional debate and has no monetary value and is non-refundable.
10. Credit System
10.1 Use of Credits
When a user uses a credit, it will only be consumed if the debate is effectively assigned and confirmed.
If the requested debate cannot be assigned, the credit will not be consumed.
This applies to both free and paid users.
10.2 Legal Nature of Credits
Credits do not constitute money or financial balance.
They do not generate a right to refund.
They are not transferable.
They are not redeemable for cash.
They have no financial value.
Credits may be withdrawn in case of fraud or abuse.
11. Referral System
A user may recommend a third party by entering their email address in the Student Area.
The process includes sending an email, double opt-in, an access video call, membership approval, and participation in the first debate.
The credit will only be granted after the referred user effectively attends their first debate.
Fraud includes self-referrals, use of multiple personal email addresses, fake email addresses, or manipulation of the system.
In case of fraud, credits may be withdrawn and the account may be cancelled.
12. Cancellation by the Organization
Club de Spanish may cancel or reschedule debates for justified reasons, including technical issues, force majeure, or inability to form a minimum group.
In such cases, paid users may receive a credit.
Free users are not entitled to automatic compensation.
13. Limitation of Liability
Club de Spanish does not guarantee uninterrupted availability of external platforms, compatibility with all devices, or the behavior of other participants.
The service is provided “as is.”
14. International Participation
The service is open to participants from any country.
The official language of the service is Spanish.
English may only be used for administrative communication or dispute resolution.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the Czech Republic.
The parties submit to the competent courts in accordance with such legislation, without prejudice to the rights that may correspond to consumers under applicable European regulations.
16. Acceptance of the Terms
Participation in the service implies full acceptance of these Terms and Conditions.
17. Modification of the Terms
Club de Spanish reserves the right to modify these Terms and Conditions at any time for legal, technical, organizational, or service improvement reasons.
Modifications will be published on this page and will enter into force upon publication unless otherwise stated.
They will not have retroactive effect regarding services already provided.
When modifications substantially affect users’ rights or obligations, reasonable notice will be given through the Student Area or by email.
Continued use of the service after publication of changes implies acceptance of the updated terms.
